1. YOUR TAILOR-MADE TRIP
"India with Mathew" ("L'Inde avec Mathew" ) offers to create your trip according to your project and desires and provides you with some ideas with various destinations, experiences and travel themes on its website www.lindeavecmathew.com (hereinafter, the "Site"). To obtain your tailor-made travel offer, we invite you to contact us to submit a request in writing by contacting us at

Generally within 48 hours, a travel consultant will propose to you, from the expression of your desires, on a written medium with a period of validity your travel program and its firm and final price, all fees, taxes and services included, except any adjustments provided for in Article 8 - Prices, below. In the event that the validity of your travel programme and/or changes in the conditions of your services are exceeded, "India with Mathew" may establish a new programme for your trip, should certain terms and conditions, in particular fares, be modified. As soon as you wish to confirm your travel program, within its validity period, you can register, by contacting us again according to the same terms.
1.1 Registration
You agree to complete the trip, as detailed in your travel program, by registering. This is achieved by signing your travel program, the "India with Mathew" terms and conditions of sale and, if applicable, the contractual terms and conditions of the proposed insurance you have chosen, which is effected by your acceptance in writing and by payment to "India with Mathew" of the travel price in accordance with the terms and conditions specified in articles 1.2.1 and 1.2.2 below.
1.2 Payment terms - invoices
1.2.1. For any registration made more than 35 days before the date of departure, a deposit of 35% of the total amount of the trip (hereinafter, the "Deposit") will be cashed by "India with Mathew". For any registration less than 35 days before the departure date, payment must be made in one go and for the full price of the trip. The amount of the insurance premium proposed and accepted by the traveller(s) for the trip is paid at registration with the receipt of the Deposit or any other amount paid for the trip.
1.2.2. You can pay the price of your trip (Deposit and then balance of the price for a registration more than 35 days before the departure date or total price for any registration less than 35 days before the departure date): (for any payment up to 35 days from the date of departure)
- on the Site, by credit card or other payment method.
1.2.3. For any payment whose amount is validated and collected by "India with Mathew", a receipt will be provided and an invoice will be sent to the person who made the registration on behalf of the traveler(s) of the travel program. In the event of registration more than 35 days before the departure date of the trip, the balance of the trip price must be paid, without any reminder of "India with Mathew", at the latest 35 days before the departure date. Any delay in the payment of the balance will be considered as a cancellation by you for which the cancellation fees referred to in Article 4 below will be applied.
You do not benefit from a withdrawal period for the purchase of travel services. Your registration is final as soon as your travel program is signed. In case of difficulty, our advisers are at your disposal.
1.3 Group tours
1.3.1. Registration
If you wish to register on one of our guided tours proposed in our offer (brochure or Site), for example a "Signature trip" we invite you to make a request either from our Site, or by contacting one of our advisors who will establish your travel program for this tour. The total price of your trip will be the one mentioned on the program of your trip, depending on the dates of your trip and you can register as specified in 1.1. above. In the event of a discrepancy between the price mentioned in the brochure and that mentioned on the Site, only the available price is applicable. The payment terms are those provided for in article 1.2. 1.3.2 Cancellation for insufficient number of participants We may exceptionally be forced to cancel the start of a tour if the minimum number of registered participants is not reached. This decision will be communicated to you no later than
2. TRAVEL INFORMATIONS
2.1 Administrative and health formalities
Before registering to undertake your trip, you must check that each of the travellers, according to their personal situation and nationality, is in possession of the valid passport (or identity card (IC) indicated for the visa) which will be used to carry out the intended trip as well as any other document(s) (visa, e-visa, ESTA authorization if in transit USA, family record book, authorization to leave the territory...) necessary and in compliance with the requirements for transit and/or entry into the country (ies) of travel. For the organisation of your trip, we inform you that some countries and/or service providers (in particular customs authorities, airlines, etc.) require the transmission of some of your personal data in order to complete forms and/or comply with instructions relating to their reservation and/or control system.
To this end, we may be required to provide these service providers with the following information: your surname, first name(s), date of birth as shown on the passport or CNI (if the
destination allows it) that you will use for your trip and to complete the transit or entry authorizations (visa, e-visa, ESTA.....), specify for each traveller (including children and babies), sex (male (M) or female (F)).
WARNING: you must provide the same information above (surname, first name(s), date of birth and gender) in the same way to complete all other forms required for the completion of your trip, including flights on American airlines or for a trip with transit through the USA. Failure to comply with this procedure may result in a refusal of entry into the transit or destination territory.
"India with Mathew" provides this information for all French nationals. For other nationalities, we are at your disposal to assist you in your efforts. It is the responsibility of each traveller to verify that his or her documents, in particular administrative and health documents, required for the completion of the trip, are in accordance with the information provided by
"India with Mathew", it being specified that it is the responsibility of the person who made the registration to the travel contract to relay information relating to the formalities to each of the travellers registered for the trip. "India with Mathew" can under no circumstances be held responsible for the consequences of non-compliance by each traveller with police, customs or health regulations. A traveller who could not carry out a transport (in particular a flight) without presenting the required documents, mentioned on the contract of sale given to him, would not be entitled to any refund.
E-visa: we propose to apply for the e-tourist visa for you and with you for a total cost of 98€ per e-tourist visa (excluding any bank charges).
A preferential rate of 95€ per e-tourist visa is charged for a trip organised by "India with Mathew". This price is subject to updates: In the event of a discrepancy between the price mentioned in the brochure and that mentioned on the Site, only the price available on the Site is applicable.
Several conditions are required to apply for this electronic visa:
- Your passport must have been issued by an eligible country (France, Belgium, Switzerland, other countries of the European Community,...). Please contact us for the exact list of countries if your case is special.
- Your passport must be valid for 6 months after your arrival.
Visa fees: Passports must be submitted to "India with Mathew" at least 40 days before the departure date to enable it to complete the visa(s) application process. The cost of obtaining a visa will be charged by "India with Mathew" at the applicable rate depending on the destination, plus, where applicable, the cost of shipping to your home and/or consular fees (visa fee) and/or passport translation fees. Any request for a visa in urgency (within 15 days before departure) will be charged by "India with Mathew" from €50 to €200 (depending on the degree of urgency of the request set by the consular authorities and the country of destination) in addition to any shipping costs and/or consular fees (visa fee) and/or any passport translation costs. In the event of cancellation/resolution of the trip, the costs of obtaining visas and the amount of the visa are not refundable by "India with Mathew" or by its insurer.
2.2 Information on safety and health risks
For formalities and information on the travel country(ies), "India with Mathew" advises you to consult the country(ies) of your trip (destination and crossing countries) available on the website of the Ministry of Europe and Foreign Affairs (MEAE) www.diplomatie.gouv.fr, section "Advice to Travellers / Advice by country". These sheets are also available on request from your "India with Mathew" advisor.
"India with Mathew" draws your attention to the fact that the information may change up to the date of your departure and advises travellers to consult it regularly.
"India with Mathew" may, for certain destinations, require you to sign the MEAE form of the country(ies) visited or crossed, as part of its obligation to provide information. This request does not constitute a disclaimer of liability. Health risks: We invite you to regularly consult the information provided by the competent authorities on the health risks of the country/countries you are travelling to
3. MODIFICATIONS / INTERRUPTIONS OF SERVICES REQUESTED BY THE TRAVELLER(S)
3.1. Transport services
After registration for the trip, any change in transport and in particular in the name(s) of the passenger(s) may result in additional costs and/or penalties, the amount of which must be paid by the passenger(s) to "India with Mathew" by any means before departure. If not cashed, "India with Mathew" cannot be required to make the desired changes.
3.2. Other services
After registration for the trip and before the departure date, any request for modification (additions or withdrawals (extension, deferred return, change of accommodation, etc.) of travel services may only be made with the prior agreement of "India with Mathew" and payment to "India with Mathew". costs incurred, by any means of payment that allows collection. If not cashed, "India with Mathew" cannot be required to make the desired changes. As from the date of departure, any request for modification and/or non-fulfilment of all or part of the trip's services will not give rise to any reimbursement of the initial services. Any new services requested during the trip must be paid in advance to "India with Mathew" or designated service providers.
3.3 Special cases
Any request for modification of the departure and/or return date may give rise to additional charges. Failure to pay the modification costs would be considered as a cancellation/termination by the traveller(s) for which the conditions provided for in Article 4 will be applied.
4. TERMS AND COSTS OF CANCELLATION / TERMINATION
If the traveller(s) registered on the trip are obliged to cancel their participation in the trip, they must inform their insurer and, the person who made the registration for the trip must inform "India with Mathew" by any written means to have an acknowledgement of receipt, as soon as the event giving rise to the cancellation occurs: the date of issue of the written notice will be used as the cancellation date for invoicing the cancellation fees. We would like to draw your attention to the following on the fact that the insurer assesses, on the basis of the documents communicated directly to it by its insured, the date of the event giving rise to the decision to cancel the trip in order to agree to reimburse the cancellation costs. The insurance premium, registration fees, visa fees (application fees and visa fees) are not refundable by "India with Mathew" or by the insurer. Depending on the services provided for your trip and in order to take into account the constraints imposed by our service providers, in the event of cancellation by you before departure, we may apply either a cancellation fee based on our actual costs justified on the date of your cancellation, or the cancellation fee schedule specified in 4.1 and 4.2 below. Unless otherwise specified, the scale provided for in 4.1 and 4.2 below shall be applied.
4.1. Total cancellation fee schedule
300 € if cancellation more than 160 days before departure
● 25% between 159 and 120 days before departure.
● 50% between 119 and 90 days before departure.
● 75% between 89 and 60 days before departure.
● 100% from 59 days before departure.
4.2 Partial cancellation fees
If one or more travellers registered on the same trip cancel their participation in a trip maintained for the other participants: - For personal services (not shared): the above cancellation fees (4.1) will be calculated for the traveller(s) who cancels on the price of the services (air tickets...) not consumed during the trip on the date of cancellation, - For shared benefits: a fee equal to 100%, regardless of the cancellation date, will be charged to the participant(s) who cancels on their share of the shared benefits of the trip, - When several travellers have registered on the same file and one of them cancels his trip, the cancellation fee is deducted from the sums collected by "India with Mathew" for this file, regardless of who made the payment. In the event of cancellation, for any reason whatsoever, costs outside the trip subscribed to "India with Mathew" and incurred by the traveller(s), such as travel expenses to the place of departure of the trip and return home, costs of obtaining visas, travel documents, vaccination expenses may not be reimbursed.
5. AIR TRAVEL
5.1 Airlines
"India with Mathew" will inform you on your travel schedule of the identity of the air carrier(s) likely to operate your flights with information on the schedules and, if applicable, the stops known on that date. In the event of any change subsequent to your registration, "India with Mathew" undertakes to inform you, as soon as it becomes aware of it and until your departure, of any changes in the identity of the air carrier(s). In accordance with our obligation, we inform you that the European list of banned airlines can be consulted on the website https://ec.europa.eu/transport/modes/air/safety/air-ban_en or requested from your advisor "India with Mathew". The boarding fees for unused tickets are refunded on request.
We would like to point out that:
- The stopover times are determined by the airlines according to their flight plans and can be modified without this constituting a reason for cancellation free of charge.
- In the event that the airline that is to operate your flight is unable to provide you with assistance, despite its obligation to provide it, "India with Mathew" may use another airline to arrange for you to travel under comparable transport conditions.
- Remote check-in procedures (before going to the airport) to obtain the boarding pass (with or without choice of cabin seat) can be carried out within the deadlines (number of hours before the scheduled flight time) set by each airline according to the flights.
5.2 Conditions of carriage
The conditions of carriage, in particular the number of authorized baggage and their maximum weight without surcharge, of the airline are available on the airline's website or on request from "India with Mathew". In accordance with international air transport regulations, any airline may have to modify without notice, in particular the schedules and/or itinerary as well as the airports of departure and destination. In the event of modifications by the airline, in particular due to technical, climatic or political incidents outside "India with Mathew", delays or cancellations or strikes outside "India with Mathew", additional stopovers, changes of aircraft, routes, political or climatic events, if the traveller decides to cancel the trip, the cancellation fees referred to in Article 4 above shall be charged. "India with Mathew" will not reimburse expenses (taxis, hotels, transport, catering...), as soon as the traveller is under the protection of the airline. In the event of delay in transport on departure or return from the trip and/or damage or loss of baggage, denied boarding (overbooking) and/or flight cancellation by the airline, it is the responsibility of each passenger, in order to enable him to assert his rights vis-à-vis the airline, to keep all original documents (tickets, boarding passes, baggage vouchers or other) and to request from the airline any written proof in the event of a baggage dispute, denied boarding (overbooking), flight delay or cancellation (hereinafter referred to as "Proof"). The traveller will send to the airline, as soon as possible, taking into account the short deadlines imposed, his claim with a copy of the Justifications and will keep the originals. The "India with Mathew" Customer Service Department may, in case of difficulty, intervene with the airline to assist the traveller in following up the claim.
5.3 Routing before departure and on return
For each traveller who organizes alone your pre- and post-routing services (transport, hotel...) to the place where the journey begins and to his home on return from the journey, "India with Mathew" recommends that you purchase modifiable services (transport tickets...) at no cost and/or refundable and that you plan reasonable transfer times between airports/trains. "India with Mathew" will not refund unused reserved services. Furthermore, "India with Mathew" cannot be required to reimburse costs resulting from an unforeseeable event or unavoidable by a third party or by the traveller who modifies the services of your trip subscribed to "India with Mathew" and/or implies the modification of the services of the trip subscribed to "India with Mathew" and/or implies the modification of services reserved by the traveller(s) to ensure pre and/or post routing.
6. INSURANCES
It is highly recommended to take out a travel and health insurance and/or cancellation contract. "India with Mathew" offers you three different insurance packages for your trip. The complete booklet of the general and specific conditions of these insurance contracts can be consulted on the Site or on request from our advisors. These contracts include coverage limitations, exclusions, deductibles and obligations in the event of a claim. We invite you to read them carefully. It is the responsibility of each traveller before or during the trip to personally contact the insurer in order to trigger the insurance benefits. In the proposed formulas, it is specified that in the event of cancellation of the insurance premium, registration fees, visa fees are not refundable either by "India with Mathew" or by the insurer. -Peace of mind contract - ALLIANZ - invoiced 4.30% of the total price including VAT of the trip The most complete contract for those who want to benefit from extended guarantees. -Credit card peace of mind contract - ALLIANZ - invoiced 2.80% of the total price including VAT of the trip. This contract supplements the limits and/or guarantees of your credit card. The guarantees of this contract only work on the condition that the totality of the travel price is paid with a multiservice bank card issued by a French, Swiss or Belgian bank: Mastercard Gold, Visa Premier, Platinium, Infinite, American Express. -Assistance plus ALLIANZ contract - invoiced 2.30% of the total price including VAT of the trip. This contract allows you to benefit from assistance at destination only, it does not cover cancellation.
6.1 Procedure for the declaration and processing of requests
• Request for medical assistance: You must contact Mutuaide (Allianz's assistance platform) for any request for medical assistance 24 hours a day, 7 days a week.

• Other claims: In the event of cancellation of your trip or any other incident covered by the travel insurance policy (flight delay, loss of luggage, etc.).
6.2 Waiver period
If you were already covered for the same benefits by a previously subscribed insurance contract, we inform you that you have a 14-day cancellation period for the subscribed insurance and on the condition that it has not produced any effect.
7. MINORS
Applications for registration for minors must be signed by the father, mother or legal guardian and marked "agreement of the father, mother or guardian".
Minors who do not travel with their parents or guardians must be in possession, depending on the destination, in addition to the identity documents (CNI or passport, as the case may be) required for the trip, of a valid authorization to leave French territory. In addition, the documents provided by "India with Mathew" will mention a telephone number and an address where the minor or adult responsible person can establish direct contact.
For minors travelling with one of their parents, guardians or other adults, it is important to ensure that you are in possession of the necessary documents for the accompanying minor (national identity card or passport) and, where applicable, authorization to leave the country) to enable him/her to leave the country and/or to establish, particularly if the minor does not have the same family name as the accompanying adult, proof of parental authority (family booklet, court decision, etc.).
8. PRICE
At the time of invoicing, the price is firm, definitive and in euros. However, up to 20 days from the date of departure, we may be required to make upward or downward adjustments, if they are not material, without the possibility of cancellation/resolution free of charge by you, to take into account any of the following variations: - the level of taxes or charges on travel services included in the contract imposed by a third party who is not directly involved in the performance of the contract, including tourist taxes, landing or embarkation and disembarkation taxes in ports and airports. If one or more travellers registered on the same file cancel their participation in the trip, the trip may be maintained for the others as soon as the other travellers have paid before departure, the possible additional cost of the services that would have had to be modified due to the cancellation of the traveller(s). Any refusal by the registered traveller(s) to pay this adjustment will be considered as a cancellation by the traveller(s) concerned, with application of the procedures provided for in Article 4. Additional costs, fees or other additional costs (tourist taxes, hotel charges (resort fees), parking fees, entry into national parks, etc.) may have to be paid during the journey by the traveller(s). These costs not included in the total price of the trip would, if applicable, be indicated on your travel program. We advise you to have an appropriate payment method for your trip.
9. LAND-BASED SERVICES
9.1 Unused services/modifications
Services not used during the trip (transfers, excursions, accommodation, car rental, flights...) due to the traveller(s) will not be reimbursed. As indicated in Article 3, services voluntarily modified on site at the request of the traveller(s) are subject to the conditions of local service providers and suppliers and any additional costs must be paid directly to local service providers, without engaging the liability of "India with Mathew". Services not used on site (transfers, excursions, accommodation, etc.) due to the traveller will not be refunded
9.2 Details on group tours
9.2.1. Single room
On tours accompanied by a group or on Signature trips, a traveller who registers alone and has not opted for a single room will be charged the single room supplement at the time of registration.
However, if we find someone who can share a room, we will deduct this supplement. As soon as the price is fixed on a basis of 3 people (room with double bed and an extra bed), as long as this distribution is not comfortable for adults, we advise you to ask for a single room. If the 3rd person wishes a single room, the supplement will be charged.
9.2.2. Number of participants
The maximum number of participants is indicated in the trip description. However, the maximum number may be exceeded by one participant in the event that the last person who registers wishes to travel with another person. The services will not be modified and the conditions of travel will therefore be identical.
10. CONTRACT ASSIGNMENT
You have the option of assigning your contract to an assignee who meets the same conditions as you for the trip, as long as the package has not produced any effects. You are required to inform "India with Mathew" of your decision by any means necessary to obtain an acknowledgement of receipt and at the latest seven days before the beginning of the trip. In the event of a contract transfer, the transferor and/or transferee must first pay the costs incurred by the transfer, which will be communicated to you by your advisor.
11. RESPONSIBILITY
"India with Mathew" cannot be held responsible for the consequences of the following events: - Loss or theft of airline tickets by the traveller(s). - Failure to present to the authorities and/or carriers (airlines...) the administrative and/or health documents required to undertake the trip and/or enter the country(ies) of travel and/or cross borders, in accordance with the information provided by "India with Mathew". - Arrival after the time scheduled for check-in and/or boarding of any transport journey, in particular by air. No refund of the transport ticket will be due by "India with Mathew" in this case. - Unpredictable or unavoidable events of a third party such as: wars, political unrest, strikes outside "India with Mathew", foreign riots to World Travellers, incidents technical or administrative matters outside "India with Mathew", airspace congestion, bad weather, delays (including in mail dispatch services...), breakdowns, loss or theft of luggage or other personal effects of travellers. - Cancellation imposed by exceptional and unavoidable circumstances, and/or for reasons related to the maintenance of passenger safety, and/or injunction by an administrative authority: in this case, "India with Mathew", reserves the right to modify the dates, schedules or itineraries if it considers that the safety of passengers, without recourse to the latter. In the event that "India with Mathew" is held liable due to the actions of the service providers, the compensation limits provided for by the international conventions. Except in the case of personal injury, the maximum financial liability of "India with Mathew" shall be limited to three times the total price of the trip.
12. COMPLAINTS
12.1 During the trip
We invite you to contact "India with Mathew" if you notice any non-conformity in the performance of your travel services, by calling our emergency number including
contact details will be provided on the documents provided by "India with Mathew". In the event of a claim, your failure to report any non-compliance in the performance of the services during your trip will be taken into account, if applicable, as long as it may have
financial consequences.
12.2 After your trip
Each traveller has the possibility to send a written complaint about the conditions of performance of his trip to "India with Mathew", as soon as possible after the date on return from the trip, accompanied by supporting documents.
13. PERSONAL INFORMATION
The information you provide us is stored in a computer file by "India with Mathew". Some information must be provided to "India with Mathew" when you register and/or apply for a travel project; it is indicated visibly by an asterisk. If you do not provide them, your requests will unfortunately not be able to not be processed. The other information requested is optional. The processing of your personal data is necessary to enable us to offer you a contract for the purpose of carrying out your trip and to carry it out. The personal information collected is used to allow you to access all information concerning your trip(s) or travel request(s), the execution of your requests (travel project, provision of travel services), offer you similar services or trips that may be of interest to you, produce statistics, subscribe to newsletters at your request and communicate to you with your agreement information relating to "India with Mathew" and its partners (news, products and services, business development and personalized offers). We would like to inform you that in order to enable us to process your order for travel services, your data will be communicated to the subsidiaries and partners of "India with Mathew", suppliers of reserved services (hotels, transporters, etc.) or to technical service providers (IT, accommodation, email distribution, service provider, online payment etc.), which may be located outside the European Union. Our subsidiaries and/or partners undertake to use your personal data only to carry out certain tasks essential to the completion of your trip, in strict compliance with your rights regarding the protection of personal data and in accordance with the legislation in force. "India with Mathew" undertakes not to transfer or sell your personal data to non-partner third parties. Your data is kept for the duration of our contractual relationship and for the duration necessary to meet a legal or regulatory obligation. In any event, if you do not contact us for five years, your personal data will be archived for a further five years before it is permanently deleted or made anonymous.
